So my first post here is a request for help. I know...not the best way to start but anyway,

I just recently bought my first Viper and I decided on a 1999 ACR. A know the ACR has 18 inch BBS wheels, KONI 2812 shocks, etc... The car was out of state so it was kinda hard to check it out. Fortunately some nice local Viper guys decided to help me out. The report was good. Everything about the car checks out. Only thing is, the car has different shocks. The dealer told me the shocks had been upgraded (remember that word - UPGRADED), but he has the original shocks in a box. I decided that was okay and I bought the car. So I flew out there and made the deal and drove it home. I forgot about the shocks. After I got home I called the dealer and he said he would ship them to me. Well it has been a month now and he still can't find them. He is telling me that I am outta luck, because the ad never mentioned the shocks. I explained to him that I understand the AD did not mention them, but instead he did. Then I said if I had known I was not going to get the shocks, that I would not have bought the car.

So, do either of us have a leg to stand on? What should/could I do?

If you don't have it in writing i think you'll have a tough time reneging on the deal.

What shocks are in the car now? Perhaps the shocks really are upgraded?

I wish they really were upgraded, what I forgot to mention was, they are standard GTS shocks.

So, even though he told me over the phone that he would give me the original ACR shocks, I don't have any hope?

probably got swapped out because it had the acr "ratttler" shocks that will drive you nuts from the noise. Shitty deal, hope it works out, if not there's a bunch of aftermarket choices for you.

Yeah, I spoke with the original owner and that was his reason for taking them out.

Can you tell me what would be the best aftermarket choice?

Why did you go with the Penske's? There is a set of ACR KONI 2812's for sale in the classifieds (haven't heard back from the seller though) for $3000. So if I am to consider spending approx. $3000 what shocks should I go for? I will drive the car mostly on the street and likely just the weekends. I foresee getting into the autocross scene and road courses, but likely no more than a dozen times a year.

If you can please also include references or links to sponsors that carry these items.

I was supposed to hear back from them today, but that did not happen. I figure I will give them until the end of the week then I will take some action. I am not sure what to do, but I guess I have until the end of the week to come up with something. I will not let this go.

I really do appreciate anybody that is willing to help out. I would rather wait until the end of the week and then I will speak to them one last time. If the outcome of the conversation is good, then I will be happy and quiet. If not, I will be happy to give names, addresses, etc...

Well my attorney says I have a very good case. A case of misrepresentation. He is going to draft up a letter and send it to the dealership by Friday. Let them mull it over the entire weekend and see if they don't just cough up a set of shocks or cash equivalent.

Well I decided to dig this one up, because have pretty much lost all hope. My attorney is not so sure about this case anymore for whatever reason and I have done all I can in calling this dealership.

I am so pissed off with this dealership and I figured I would post their contact info in case someone here wants to drop them a line. /images/graemlins/supergrin.gif Also I did pick up a set of Penskes, but I still want the ACR shocks in case I ever decide to sell the car.
