I wonder who was at fault? I know he rear ended the car in front of him but it depends on the traffic laws. I lived in Italy for nearly two years and one of the laws I vividly recall was...When traveling on the autostrada (highway, better known in Germany as the autobahn) in the left lane, you had the responsibility of getting out of the way of cars coming up behind you. In other words, if you get rear ended on the highway, it was your fault because YOU didn't get out of the way.
