FAIRFAX, Va. — Sniper suspect Lee Boyd Malvo's (search) lawyers filed notice Thursday that they will mount an insanity defense at his murder trial next month.
A court-appointed psychiatrist has met with Malvo more than a dozen times in recent months and those conversations formed the basis for the decision, according to defense lawyers.
The prosecutor, Fairfax County Commonwealth Attorney's Robert F. Horan Jr., said he has seen the report compiled by the mental health experts hired by the defense, and he disputed that it supports a finding of insanity.
"It says absolutely nothing about insanity," Horan said. "Apparently it's a late-blooming insanity."
Malvo, 18, is set to go on trial Nov. 10 in the slaying of FBI analyst Linda Franklin (search) outside a Home Depot store. She was among 13 people who were shot, 10 fatally, during a three-week spree in the Washington, D.C., are last fall.
The other sniper suspect, John Allen Muhammad (search), 42, goes on trial Tuesday in the slaying of man who was pumping gas near Manassas.
Both trials were moved 200 miles to southeastern Virginia.
Muhammad's lawyers have argued that Malvo was the triggerman, while Malvo's defense team has contended that the teenager was acting under the influence of the older man.
Both defendants could be sentenced to death if convicted.
Along with the 13 shootings in Maryland, Virginia, and Washington, D.C., the two are suspected in or charged with shootings in Georgia, Alabama, Louisiana, Arizona and Washington state.
Anyone that kills someone for no reason is Crazy but not Insane.
That would make most Killers Insane, thus excused. I only care when they stick a fork in him and he is done.
I say put him in a room with the victims families and fuhgedaboudit..........After they beat him to a pulp jail him again and tell the inmates he's a pedophile.....That would be justice
This is one of the many things that is wrong with our justice system. It's been a year since the crimes were committed and they haven't even started the trial. And if they get sentenced to death they will spend nearly 20 years on death row and survive many of the victim's relatives and friends.
Sad but true. It's a shame that an athlete accused of rape will go on trial before two clearly guilty, cold blooded, murderous killers who literally held America hostage for so long.
Well, My thoughts are that if your insane and that is your excuse for murdering peolpe in a cowardly manner then it's more the reason to commence the death sentence. Broken minds can't be fixed.
I honestly feel (and I'm not kidding) that in some instances there should not be a trial. That if the crime is so severely cruel, and the evidence is clearly stacked against you (caught red-handed), that you forefeit your right to a trial & immediately get the death sentence.
You're probably right. Guess that's why I'm not in charge. But it really bothers me when scum like this get to take advantage of the system. They committed one of the most heinous crimes of our time and to think they might get off on some bs technicality infuriates me. I could live with the fact that under certain circumstances, the accused would have to go straight to trial. And that justice/sentencing would have to be ultimately carried out within about 2 months time. Or at least a shortened specified period of time.
Agreed King, but even if Malvo pleads insanity, its really just a formality. That guy will get the death penalty, or atleast life without the possibility of parole. And in my eyes, a life in prison is worse than death.

Agreed...For a crime like this death is the easy way out...He should suffer every second of every minute left in his natural life...Life without parole is true punishment for this fucker...May it be filled with many playful episodes of drop the soap and hide the plunger:fist:
