So I used a consignment shop to sell the Viper. It sold last Saturday (9 days ago) and I have yet to get the money.
The excuse has been that the customer paid with a draft from his credit union and the money hasn't cleared yet. When the money appears in their account they will cut me a cashiers check. In this day and age don't these things clear in 24-48 hours, max? Additionally, I am getting the run-around and the owner is never there. It seems to be only idiot sales guys who insist I need to speak to Tom.
I can't tell if they are just a bunch of clowns or if I should be really worried? I have not signed the title.
If it was a wire transfer then it is immediate.
If the customer paid with a bank check or certified check then it will take 1-2 weeks for the $$ to be in their account.

If they would actually communicate I wouldn't be so worried. Everything might be fully normal but they act very sketchy.
Just dont give up the title until you get the money! If you dont get the money in a few days you can always get a lawyer to write a nasty letter and scare them a little. Good luck. There was a shop like that where I live that did this to hundreds of people then went bankrupt. The dealer had written permission to sell their clients cars so they sold them in bulk to local dealers and a fraction of the asking price and ran off with the money. I know there is still a huge lawsuit pending but I dont know what good it will do. They technically had permission and then went bankrupt. At least you still have the title.

If the customer paid with anything other than cash or wire transfer, it could take weeks before the funds are "verified". Verified, meaning not just that the funds were transferred but that there has been enough time gone by for any forged or fake checks to be caught.

Have they delivered your car to the customer yet? If they have get the S.O.B. back ASAP.....the customer could be riding in your ride knowing that the draft will not clear. I've had this happen to me here at the dealership before. We do not deliver the car until the DRAFT clears no questions period!!

If that check ends up not clearing and even if they get that car back I'm sure it will be abused very hard. Potentially not a good thing. Call the flunkies who answer the phone and ask them the dispensation of the car.

Exactly I delivered a new diesel one time on this. Draft didn't clear....long story short truck came back to me with over 2,000 miles on it and over $1500 in damages!!

Had to deal with the same thing when I sold my car. It sucks, but no way around it.
i got screwed once for 49g on a capital one loan check...now i only do cash or cashiers check written at a bank of my choice.

That would suck if it was already delivered. I've never done a consignment, but generally isn't the vehicle/property held or kept at the place selling it, and not the owner?
Well, I decided that since I have more lawyer friends than I can count, I should let them handle it.
They got a call from my lawyer, we'll see what happens. I believe they released the car after getting confirmation from the credit union. The money will get to them, that much I am sure of, but I am more concerned with the money getting to me.
Part of me really thinks they aren't trying to screw me over, they are just a bunch on ass clowns.
