I think this is something that needs clarity in our "bylaws". Does someone really need to "break the rules" to be up for a banning poll? I think the rules dictate what will constitute grounds for banning. But the site guidelines are not "all inclusive". I think Gerald did make the effort to put up a LEGITIMATE motion for a banning with the reasons why stated clearly. It was also clearly seconded. Whether or not any rules were broken is debatable...Gerald can argue that he was trolling. So its put to a vote by the membership.
Its a delicate balance here. If we legislate more "laws" saying these are the ONLY reasons to ban someone, then we limit the power of the membership...more government. Thats just as bad as randomly banning people. On the other hand, if we just make it too easy to ban someone it the system can be abused or even used against us. I think the safeguard here is that we have some good moderators with a good head on their shoulders that will put a "little bit" of checks and balances in the system if it clearly becomes "abuse".

Calling a Banning Poll simply to make a point, one that you know will not "pass", is abuse - plain and simple.
If I made a motion to ban SmokinV10 today for being a "troll" and got remster to second it - would you support posting the poll? Maybe you would simply because I made an example of it; but the truth is, you wouldn't. If for no other reason than we all know one wouldn't pass.
