The case should have been thrown out as soon as the two that died were found to be illegal immigrants. Coming into this country illegally is one thing enough to deserve HARSH penalties, IMO, including death (that's what you get in other countries for the same offense), but coming here illegally and committing criminal activity should be a swift ticket to the broad side of buckshot.
If this would have happened in Arizona, he'd be in jail! Our law specifically states that you have to be "in fear of your life", and if the perps were running away from the shooter, in our state, he's not in fear of his life as they were going away from him. I have a CCW permit, and carry all the time, but still have that little feeling in the back of my mind about the law NOT being on my side if the situation ever comes up. We need the Texas law here!! I wouldn't be a bit surprized if the "families" of the victims sue in Civil Court with some scum sucking attorney taking the case!
Texas law is smiler about fearing for your life part.
And you aren't supposed to shoot them in the back unless it's at night (and they are stealing stuff from you or a neighbor and running off with it)
But it was 2pm! The grand jury just cut him a lot of slack.

I almost missed the News about Joe Being No-billed since I am out of State right now,hopefully this puts the Dirtbags on Notice, that they can be Gunned down by the Good Citizens of Texas at will.BTW I was joking with my neighbor before I left, that he has my OK to "Joe Horn" anyone breaking into my house while I am away,he laughed and told me No Problem.
No big loss. Being "illegals" though really doesn't have much to do with this though, if you separate yourself from the immigration debate. This was simply a case of a homeowner capping two buglers, regardless of where they were from.
I'm a bit surprised though that them being shot in the back wasn't an issue for the grand jury. I'm certainly not pro criminal, and I'm more than happy to have as many thieves wiped off the face of the earth as possible, but shooting a man in the back doesn't present much of a case of self defense since it usually denotes running away. But, alls well that ends well, so.....tough luck if you break into someone's house.
