Re-read my posts in this thread. I agree with you and the others that are saying he should get his license revoked. I am just curious as to whether it will or will not be taken away.
And thanks for your insight Bobby. Even if he weasels through this one, I am sure it is only a matter of time until he racks up a couple more.......sadly.
ok...my bad. But even my response was just a frustrated generalization of young kids everywhere who have daddy's that get them off of whatever shit they stir up. It wasn't necessarily directed at your friend, but more of just a commentary from me and the position I take.
I heard that NJ has a state indebtedness of $32 Billion or like $13,600 for every family of four ($3,400 each). The scary part is that doesn't count the obligations for state pensions and retiree health care. The report said if you included this the total would be something like $106 Billion!
I think the national debt is a lot of smoke and mirrors, and not insurmountable when looked at in the context of GDP. However state debt is a whole other animal. All that being said, Texas has a surplus this year of $13 Billion, and our state constitution insists that the budget is balanced each year (although they just raised the tuition at the state universities).

I hope your friend gets his license revoked before he kills someone or himself.

We have more illegals here than anywhere in the world, everyone is on welfare or some state BS and no shit they even advertise food stamps on the radio and say you don't even have to come in, just call them! NO SHIT! They also give free electric and gas away on the radio too for low or no income folks, so the entire state keeps writing checks and growing debt. Combine that with corruption and incompetent individuals in managerial capacities and it is GW squared. NJ sucks, but at the rate my little computer company is growing and my bank rolling along I have to stay here longer than planned and move away. Oh yes, we have the highest property taxes in the USA too...
Back to the thread, I hope this kid understands that he needs to slow down, keep his car in top shape and or learn to drive like a race car driver if he is going to continue driving the way he does...

RD, there is no question at all im right. i just went thru this last april. I paid a higher fine to get the points taken away. im too lazy to go google it but it was something like 99-01.
i didnt know it obviously but my lawyer did. its a state thing.it happened in pompton plains.
and this but im not sure if this is what im talking about. i clearly remember my lawyer telling me every NJ driver has 2 get out of jail free passes and told me to make sure i use them on higher point tickets. sorta remember him saying a 5 point ticket goes to a 2 pointer too.....so i could be somewhat wrong on my original statement ?
Quote:
New Jersey Municipal Courts permit plea bargaining on all offenses except Driving While Intoxicated (DWI) and Drug Cases. In many instances, a municipal court prosecutor will down grade a 2 point speeding ticket to a 0 point ticket ( NJSA 39:4-97.2 - Unsafe Driving) without the necessity of being represented by counsel. This assumes that there are no extraordinary circumstances surrounding the speeding ticket that you received (no accident, no injuries, no problematic conversations between you and the police officer who issued the ticket and you have a good to fair driving record).
The New Jersey Legislature recognized that many good drivers make mistakes. They provided for those mistakes by creating a statute, specifically NJSA 39:4-97.2 Unsafe Driving. There are no points associated with that statute, however, the statute can only be used two times within a five year period. Should you pled guilty to NJSA 39:4-97.2 Unsafe Driving a third time within five years, DMV will assess 4 points against you.
there is a statute avail to NJ drivers that lets ya pay to get out of trouble. you can pull this card twice in your lifetime. i dont remember what it was called but its like 99-01 , ask his lawyer, he will know it for sure.
basically you pay a lot more to NOT get the points. it can be used on any ticket. so obviously im saving it for a biggie.
he DOES have a lawyer right ? if not, he better get one fast.
It's NOT a statute...it's a discretionary non-moving violation ticket that doubles your fine and court costs but has no points associated to it because it's non-moving. You can bargain for this ticket 3 times in 3 years, the fourth will automatically assign 4 points to your license. Generally, the most points that the prosecutor or judge will bargain for is 4 total in any single ticket. Depending on which court he goes to, he may get to keep his license but with a lot of points, I believe he's actually better off losing his license for a while as it willl then only reflect a suspension and not point total...
Note: I am not a lawyer nore do I play one on TV.... just have a lot of experience with the NJ points and court system.
Fuck.... don't you hate it when someone posts something relevant when you're typing your well thought out , non-sensical reply..

i swear he told me twice but 3 is better for me so im not gonna argue...lol
and i also know he told me it had a statute number but who the hell knows. all i know is my tickets got reduced to zero points and cost me a lot more money which i was more than happy to pay out.....
In Florida once every year you can go to driving school to have the points removed from your driving record. So if you get a ticket a year you will be OK. You still have to pay the fine and take a driving class either on the net or in a classroom setting. I have taken 4 so far in 20 years and still maintain a clean record with my insurance company. It's all about the Almighty Dollar.

I think "statute" would imply that it's a law, it's not, it has a NJDMV # assigned to and it goes on your driving record as a non-moving violation which carries no points. The insurance Co.'s know when you get them and what they are but cannot penalize you without the points. Most courts will not allow you to use this ticket for speeding above a certain mph...
