A Bronx, N.Y., day laborer living and working illegally in the United States has been awarded a $4 million settlement for injuries suffered on the job, the largest ever award of its kind, the New York Sun reported Tuesday in a Page One story.
The undocumented Mexican native, who did not want his identity known out of fear that news of the settlement would put his family at risk of kidnapping in Mexico, fell 30 feet from a scaffolding at a construction site Oct. 18, 2001, the paper said.
As a result, the 33-year-old migrant suffered numerous injuries, including a collapsed lung, loss of one eye, loss of his sense of smell, and brain damage, the paper reported.
The Mexican’s trial attorneys were pleased with the result – the largest award ever won by an illegal immigrant in the U.S.
"The lesson today for all the undocumented immigrants of New York is they have the same rights to access the courts in New York City as any American citizen," Brian O'Dwyer of O'Dwyer and Bernstein LLP told reporters Monday.

Even if it doesn't cover it, and the employer goes bankrupt, the taxpayers still pay, because that business isn't doing the work, and there's costs associated with that, like going through a new bidding process for another company to do the work, etc.

Oh I'm not saying the taxpayer doesn't get screwed. We pay for the healthcare, the change in construction contractor, the lost jobs of the construction contractor, the judge/jury/court costs to hear the case, etc. etc.

I was speaking hypothetically, I know the taxpayers will wind up paying, but in the perfect world we live in, this is how it should be. That a better splanation?
So if a business hires illegal aliens, they should be able to subject them to whatever dangerous conditions they want without fear of repercussion? I am not sure we can have 2 different sets of safety standards based on who you are.
Part of the employment process is that you check worker eligibility.... they knew what they were doing - and it's a distinct possiblity that some businesses hire the illegals to skirt OTHER laws, as well, in hopes that the illegal workers will be too scared to report anything.
I am not a fan of illegal immigration, but stop the source and weed these folks out. As long as it's possible to hire these folks and not get caught and pay them less than their "legal" counterparts, they will continue to sneak into this country. Supply and demand, ya know. Yes...The messicans perform work that your average American will not, and they are NOT "illegal aliens", they are simply "undocumented workers".
