holy shit if that would of happened to me when he came to the window with the tire iron, I would have emptied my H&K 40 cal into his fucking face. As long as I fear for my life and someone smashing my DRIVERS SIDE window with a tire iron sure as hell is going to be a open and shut case.

And he attacked you with a deadly weapon. Yes you were in a car, but he broke the windows on the driver's side. I'll will to argue that the driver was in fear for her safety.
