It's NOT a statute...it's a discretionary non-moving violation ticket that doubles your fine and court costs but has no points associated to it because it's non-moving. You can bargain for this ticket 3 times in 3 years, the fourth will automatically assign 4 points to your license. Generally, the most points that the prosecutor or judge will bargain for is 4 total in any single ticket. Depending on which court he goes to, he may get to keep his license but with a lot of points, I believe he's actually better off losing his license for a while as it willl then only reflect a suspension and not point total...
Note: I am not a lawyer nore do I play one on TV.... just have a lot of experience with the NJ points and court system.
